ALBANY – A man injured in a car crash caused by a teen who had left a nonsecure juvenile detention center without permission three weeks earlier may not sue the facility for negligence, a state appeals panel has ruled.
A unanimous panel of the Appellate Division, Third Department, decided that the Berkshire Farm Center and Services for Youth was not liable for the crash that occurred as the teen sought to elude police in a high-speed chase in June 2012. Plaintiff Nicholas Mayorga was seriously injured in the crash.
