A jury should decide whether a man, acquitted of weapons charges after spending eight months in jail, has valid claims for false arrest, false imprisonment and malicious prosecution against the New York City Police Department, a state appeals court has affirmed.

The 3-1 Appellate Division, First Department, panel denied the city’s motion for summary judgment of Hector Mendez’s complaint that he was falsely arrested and tried on second- and fourth-degree criminal possession of a weapon charges.
