An upstate appeals court has ruled that, due to contradictory evidence in a wrongful death lawsuit against a Buffalo police officer who shot and killed a man during a scuffle over a pellet gun, the suit should continue.

In 2009, Garry Connors allegedly robbed a pharmacy with a pellet gun and witnesses reported his license plate number to police.
