New York City and state have defeated FedEx’s attempt to throw out multiple claims that it shipped cigarettes to New York residents in violation of two federal statutes.

Southern District Judge Edgardo Ramos denied the motion to dismiss by FedEx, which is being sued under the Contraband Cigarette Trafficking Act (CCTA), 18 U.S.C. §2341, and the Racketeer Influenced and Corrupt Organizations (RICO) Act, 18 U.S.C. §1961.
