A federal judge has held that the New York City Department of Buildings does not have to face disability and housing discrimination claims over the failure of landlords to keep elevators running during city-permitted replacement or repair jobs.

Southern District Judge Deborah Batts dismissed claims that the Department of Buildings (DOB) and Commissioner Rick Chandler enabled long delays by landlords in restoring elevator service in four buildings in the Bronx with a number of disabled residents, finding that the landlords’ actions cannot be imputed to the city.
