John Pereira, a New York bankruptcy trustee who was suspended for failing to offer interpreter services and berating some debtors, is challenging his suspension in a suit filed Thursday in the Southern District against the Justice Department and the U.S. Trustee Program.
Pereira, a partner at Pereira & Sinisi, is a longtime member of the panel of Chapter 7 trustees in the Southern and Eastern districts. The U.S. Trustee for the New York region, William Harrington, suspended Pereira in September 2014 after receiving attorney complaints about his conduct. The director of the Trustee Program, Clifford White, upheld Pereira’s suspension in a March 4 decision, finding his language toward some debtors was “harsh, accusatory, demeaning” (NYLJ, March 15).
