A state appeals court has dismissed a claim that two of the leading initiatives of Andrew Cuomo’s governorship—an expansion of casino gambling and the START-UP NY program—were adopted unconstitutionally.

In Schulz v. State of New York Executive, Andrew Cuomo, 520670, an Appellate Division, Third Department, panel unanimously rejected the contention that Cuomo failed in the messages of necessity he sent to the Legislature in June 2013 to explain why lawmakers should expedite their consideration of the bills related to the initiatives.
