A sharply divided panel of the Appellate Division, First Department, upheld a $1 million jury verdict Tuesday against the New York City Transit Authority in a bus fatality case.
A three-justice majority said the plaintiffs had produced sufficient evidence for a jury to find negligence, even though neither the driver nor the passengers saw the accident.
