ESTATE OF CHRISTINE E. CHRISTIE, Deceased (15/950) — Within the context of the underlying contested probate proceeding, respondent, John Scott Christie, moves for an order pursuant to CPLR 3214 and 3126 compelling petitioner to comply with his disclosure demands. Petitioner, Pamela C. Kart, opposes the instant application. For the reasons set forth below, the application is denied and the “NOTICE FOR DISCOVERY & INSPECTION,” “DEMAND FOR ELECTRONIC MEDIA” and “DEMAND FOR AUTHORIZATIONS” are stricken.

This matter concerns the validity of a purported will of this decedent dated December 8, 2006 which has been offered for probate by Pamela C. Kart, the nominated executor. John Scott Christie filed objections to this instrument on June 23, 2015 asserting lack of capacity, undue influence, fraud and improper execution. On August 4, 2015, the parties entered into a stipulation which charted the course for disclosure in this litigation. That stipulation was “so ordered” by the court. Pursuant thereto, on or about August 31, 2 015, respondent served his demands on petitioner. On or about September 22, 2015, petitioner served her response which objects to disclosure on the grounds that the demands are over broad, vague, burdensome, and outside the scope of disclosure permitted under the Uniform Rules for the Surrogate’s Court (22 NYCRR 207.27). Having failed to receive the information demanded, respondent made the instant application seeking compliance with his demands.
