ESTATE OF STELLA HANDLEY, Deceased, (11/1487/I) — By decision/order dated May 12, 2015, the underlying proceeding for discovery, pursuant to SCPA 2103, was converted by the court into a turnover proceeding, upon respondent's repeated default in appearing. The chronology recited in this court's decision/order dated March 17, 2015 is incorporated herein, and is also reflected in petitioner's supporting papers (See Estate of Handley, File #2011-1487/1, 3/17/2015 and 5/12/2015, S. Czygier). After additional attempts to schedule an inquest, the court directed counsel for petitioner to submit any documentation supporting his position to the court for review, anticipating final submissions by February 19, 2016, while reserving its right to schedule a hearing (See Estate of Handley, File #2011-1487/1, 11/19/2015, S. Czygier). As she has in the past, respondent has provided the court, with a faxed letter from a physician, who is purportedly treating respondent, indicating that, she "is not mentally capable" of appearing in court, and that she should be excused from court appearances through April 1, 2016. Respondent has not submitted any documentation in opposition to petitioner's submission (s) herein, but for this fax transmission.
