ALBANY – An upstate appeals court has faulted a trial judge for acting too quickly in throwing out a drunken driving arrest by Mohawk Indian police that occurred off tribal land.

A panel of the Appellate Division, Third Department, reversed St. Lawrence County Court Judge Jerome Richards‘ dismissal of a nine-count indictment against Joseph Back II, including four felony assault and vehicular assault charges, in a March 2014 accident in which another motorist was severely injured.
