A man who was convicted following a jury trial at which the judge had him removed from the courtroom without warning him of the consequences of his loud interruptions will receive a new trial, an appeals court has ruled.

A panel of the Appellate Division, Second Department, reversed the conviction, saying in an unsigned ruling last week that the judge failed to issue a warning to Burton that if he continued his disruptive behavior, he would be removed.
