A judge who disqualified defense counsel and declared a mistrial was found not to have implicated a man’s rights against double jeopardy.
Dutchess County Court Judge Craig Stephen Brown said there was a “manifest necessity” for the mistrial but refused to dismiss Stanley Kocot’s indictment for predatory sexual assault against a child and related offenses.
