The multimillion-dollar dispute between a Kazakh oligarch and his former financial advisor should be heard by a New York court and not a London arbitration association, a split Manhattan appellate panel held Tuesday.
The Appellate Division, First Department, said that a forum selection clause in the earlier of four agreements between the parties designating New York courts for the resolution of disputes controlled the matter, notwithstanding the fact that later agreements cancelled the earlier one.
