A rock escarpment in a state park is not a “building or structure” for purposes of a job-related injury that a man sustained while rappelling down the cliff during a work assignment, a state Court of Claims judge determined.

Albany County Sheriff’s Investigator Eric Burns was hit in the face by a falling rock while participating in a training exercise in which he agreed to help break loose rocks off the escarpment so they would not fall onto a popular hiking trail.
