A single civil traffic infraction on a man’s record did not justify a 10-year mandatory minimum sentence for a drug felony, a federal judge has ruled.

Eastern District Judge Jack Weinstein said the prison term that the U.S. Sentencing Commission called for was “so inconsistent” with federal appellate law, state law “and common sense as to require rejection of the commission’s position.”
