Indigent defendants will get a second chance to pursue further appellate relief if their lawyers fail to tell them in a timely fashion that they lost their federal appeal, the U.S. Court of Appeals for the Second Circuit has ruled.

The circuit said Friday that it will henceforth restart the clock on requests for rehearing denied when defendants were unaware of the end of their cases. They also will be appointed counsel under the Criminal Justice Act.
