A Manhattan appeals panel has revived a negligent misrepresentation claim against a lawyer who made written assurances to a hedge fund investor, even though the investor was not a client.
Alvin Chanin claimed he lost his entire investment in the fund because he relied on the lawyer’s assurances that inquiries the Securities and Exchange Commission was making about the fund were routine.
