T-Shirts worn by a handful of spectators at a murder trial showing victim’s picture with the words “R.I.P.” were not prejudicial to the defendant, a unanimous panel of a state appellate court had ruled.

While the trial judge should have instructed the spectators to cover up the shirts or to remove them during the trial of Justin Jones in Chemung County Court, the error was harmless, the court concluded.
