A $5 million excessive force verdict against New York City was toppled by a Brooklyn appeals court that said the case should not have gone to the jury.

The Appellate Division, Second Department, ruled that a city motion for judgment as a matter of law should have been granted in its entirety, thus precluding a jury from deciding whether police officers used excessive force on and acted negligently with Demetrio Davila.
