An ailing paraplegic defendant who was barred from attending his jury trial by videoconference did not waive his right to be present, according to a Manhattan appeals court.

Noting the “unusual circumstances” of the case, a unanimous panel of the Appellate Division, First Department, ordered a new trial for Christopher Krieg in People v. Krieg, 1309.
