A judge has continued a civil rights suit claiming that the City of Utica is more aggressive at fighting fires and rescuing victims from upscale residences than from buildings with low-income dwellers.

Northern District Judge David Hurd said the plaintiffs, who are the relatives of four people killed in a 2009 fire in a poor Utica neighborhood, have raised questions about whether the fire department’s response was, in fact, affected by the economic status of residents.
