ESTATE OF LOUIS H. SEEGERS A/K/A LOUIS H. SEEGERS, SR., Deceased (15/1161/A) — Before the court is a motion by petitioner seeking injunctive relief against the respondent herein, pending the outcome of the underlying proceeding. For the reasons set forth herein, the motion is denied.

The record reflects that captioned decedent died intestate on January 30, 2015, survived by five (5) adult children and four (4) grandchildren. Letters of administration issued to petitioner herein on May 22, 2015. Shortly thereafter, the petitioner brought the underlying proceeding seeking the turnover of property allegedly belonging to captioned decedent’s estate; the proceeds of a sale conducted prior to the decedent’s death of certain realty at 50 Grist Mill Drive in Kings Park, New York. According to petitioner, respondent, the decedent’s companion/girlfriend, attended the closing with a power of attorney as the decedent’s attorney in fact. Petitioner asserts that the property sold for approximately $250,000, that the power of attorney did not contain a gift rider and that the funds never found their way into the decedent’s bank accounts.
