An appeals court has ordered a new trial for a Brooklyn slip-and-fall case in which the defendant’s attorney tried impeaching the disabled plaintiff’s guardian with questions about her criminal history.
According to court papers, Marie Claude Morency, who is mentally and physically disabled and nonverbal, fell while walking down the steps of an ambulette owned by Horizon Transportation Services. She suffered an ankle fracture that required surgery.
