Dismissal of a $70 million fraud suit brought by a prominent private equity fund against stockholders of an Israeli company was warranted, an appellate court ruled.
Manhattan-based fund MatlinPatterson, with $4.3 billion in assets, said it was defrauded by the founders of DuCool, Ltd., an Israeli company that claimed to have had breakthrough dehumidification technology.
