ALBANY – A mother who gave her 8-year-old son Benadryl three or four nights a week to “help him fall asleep” without consulting a physician has lost primary physical custody of the boy.

An Appellate Division, Third Department panel agreed unanimously with Ulster County child welfare officials and the boy’s father that the mother’s use of the over-the-counter antihistamine on her son justified removal of the boy from her home and shifting physical custody to the father.
