A Manhattan judge ruled that a crane operator on the New York/New Jersey waterfront who lost his license for possessing prescription pain medication and selling pills to fellow longshoreman should receive a chance to get his job back.

Ruling on an Article 78 proceeding, Manhattan Supreme Court Justice Alice Schlesinger said the two-member Waterfront Commission’s decision to deny reinstatement for Kenny Picinich—who admitted to selling pills to coworkers but was not convicted of a crime following his completion of a drug treatment program—was “mean spirited.”
