Judges who had a “significant, personal involvement” in a case during their previous role as a prosecutor must recuse when ruling on the case at a later stage, the U.S. Supreme Court ruled Thursday.
Justice Anthony Kennedy, writing for a 5-3 majority, ruled that, “Under the due process clause there is an impermissible risk of actual bias when a judge earlier had significant, personal involvement as a prosecutor in a critical decision regarding the defendant’s case.”
