An appeals court Wednesday reversed a Supreme Court justice’s civil contempt finding against the state Board of Parole for the way it decided whether a convicted murderer should be released after nearly 30 years in prison.

A unanimous Appellate Division, Second Department, panel said in Matter of Cassidy, 2015-06927, that Michael Cassidy did not meet his burden of proof that the parole board “violated a clear and unequivocal court order” and prejudiced his rights by denying him parole in May 2015.
