POINTING to “pervasive prosecutorial misconduct” during both opening and closing statements, a state appeals court on Wednesday reversed a second-degree murder conviction secured by Queens prosecutors after a 2011 jury trial.
The defendant, Derrick Redd, had been serving 25 years to life for allegedly stabbing his pregnant girlfriend 20 to 30 times on the date her baby was due in 2008, killing both the fetus and mother. Redd will now face a new trial, a panel of the Appellate Division, Second Department, ruled.
