The state Workers’ Compensation Board was within its authority when it reduced attorney’s fees sought by a Westchester County law firm for representing a New York City correction officer, an appellate panel decided unanimously.
The court said the board was “fully authorized” to conclude that the refusal of the Sleepy Hollow firm of Rella & Associates to pay a $750 penalty for 18 months represented a dilatory tactic. The board slashed the attorney’s fee request, first to $10,000 and then $5,000 for the firm’s 20 hours of work on the case.
