An appellate court has modified an injunction it issued in June by allowing the sponsors of a disputed park project to drive nine piles that would support a platform of land over the Hudson River.

An appeal on the merits of the injunction in the Pier 55 project is scheduled to be heard by the Appellate Division, First Department, on Sept. 6 (NYLJ, July 8). In the meantime, the court ruled Monday in City Club of New York v. Hudson River Park Trust, M-3261, some construction work may proceed.
