A state appeals court has ordered a hearing in a decades-old murder case to determine whether a Bronx prosecutor wrongfully held back information that a witness had struck a deal with federal prosecutors before he testified.
In a 14-page decision Thursday, the Appellate Division, First Department, found that a prosecutor with the Bronx District Attorney’s Office in the 2007 trial of Ricardo Jimenez might have violated Brady v. Maryland (373 US 83 [1963]) rules for turning over impeachment evidence.
