A panel of Appellate Division, First Department, agreed in Morgan v. Worldview, 652323/14,on Thursday with a Manhattan Supreme Court Justice Eileen Rakower that Hoyt Morgan’s claim for breach of contract against Cestone and Conners could move forward.
The panel also affirmed a decision requiring Worldview Entertainment Partners VII, an entity used to help finance “Birdman,” to hold on to at least $2.7 million which would likely cover all of Morgan’s potential damages, according to his lawyer, Usher Winslett, a partner at Winslett Studnicky McCormick & Bomser in New York.
