Seeking to end seven “tortuous” years of uncertainty over the paternity of a 15-year-old, a judge said he was entering an order of filiation for a man who wants to be the girl’s father, despite an apparent conflict with New York’s Family Court Act.
Bronx Family Court Justice Sidney Gribetz’s ruling vacates the acknowledgment of paternity that another man signed soon after the April 2001 birth of the girl, identified as “Emily R.” The man who signed the paternity acknowledgment, identified as “Mr. R.,” has had no meaningful contact with the girl since she was about a year old, according to the judge.
