A judge was within his discretion when he added three years to the prison term of a defendant who threatened to harm him during an outburst at sentencing, an appeals panel ruled Thursday.
Justin Elmendorf’s threats resulted in a 15-year sentence from Ulster County Judge Donald Williams Jr. instead of the 12 years Elmendorf would have received for first-degree burglary under a plea agreement with prosecutors.
