A defendant who has been a victim of sexual abuse and suffers from mental illness should be incarcerated in a medical facility rather than prison to protect him from further abuse and lengthy stays in solitary confinement, a federal judge ruled.

In a 215-page decision, Eastern District Judge Jack Weinstein said that Darnell Washington, who was convicted of possession of child pornography and sexual exploitation of a child, likely faces “harsh and dangerous” conditions in prison, increasing his risk of committing suicide—something he has attempted numerous times in the past.
