An imminent threat to law enforcement permitted warrantless access to a murder suspect’s cellphone location data, a federal appeals court has ruled.

The U.S. Court of Appeals for the Second Circuit said police had the right to access to Frank Caraballo’s cellphone service provider and use of GPS software in the phone to find Caraballo for the 2011 murder of narcotics asso­ciate Melissa Barratt.
