The one-time principal oboist for the Buffalo Philharmonic Orchestra has lost a second bid to have a federal court intervene to save his job.

Western District Judge Richard Arcara on Monday affirmed a May report and recommendation from Magistrate Judge H. Kenneth Schroeder Jr. dismissing a suit filed by oboist Pierre Roy in which the musician contested his termination.
