A Surrogate Court’s judge has ordered a forensic examination of a lawyer’s computer to help resolve questions about the authenticity of a will the attorney prepared on it before the device malfunctioned and files related to the document were lost.

Erie County Surrogate Judge Barbara Howe concluded in Matter of Nunz, 2012-4075/A, that there is a “proper basis” to proceed with the forensic testing of the Apple iMac computer on which attorney Keith Perla drafted the will of William Nunz Sr. on Aug. 17, 2012. Nunz died about a month later, at age 79.
