Occupy Wall Street protesters can pursue their claim that police violated the U.S. Constitution when they were targeted for protesting, herded into a press pen and detained outside of a fundraiser for President Barack Obama in 2011, a federal judge has ruled.

Southern District Judge Thomas Griesa denied summary judgment to New York City on the protesters’ Fourth Amendment false arrest and other claims stemming from their detention for over an hour outside the Sheraton Hotel in midtown.
