The 2015-2016 term of the New York Court of Appeals saw the near completion of the changing of the guard. Gov. Andrew Cuomo has now appointed six of the Court’s seven members. Chief Judge Jonathan Lippman and Judge Robert Smith are gone, and Chief Judge Janet DiFiore and Judge Michael Garcia have replaced them. Early results suggest that the new Court will be moderate and pragmatic in its criminal law rulings. Now to the term’s cases.
