A New York appeals court has affirmed the dismissal of a breach of contract case claiming the Port Authority of New York and New Jersey caused a steel company to lose millions of dollars when it allegedly changed the timing and scope of the company’s installation work on the National September 11 Museum.

A unanimous panel of the Appellate Division, First Department, on Thursday affirmed a trial court’s dismissal of W&W Steel LLC’s breach of contract case, finding the company failed to file its lawsuit in time.
