ESTATE OF LA FRANCES HILLS, Deceased (15/734/A) — This is a proceeding to probate the Will of La Frances Hill (testator), who executed an instrument dated February 13, 2007 (the Will). The Will is propounded by the nominated executor, Margaret English (proponent). The testator died on March 16, 2009, survived by a son who is now deceased and three grandchildren, who are children of the post-deceased son. Although all three grandchildren appeared in the proceeding, only one of them, Gerald Williams (objectant), filed objections to probate alleging undue influence, fraud, and lack of testamentary capacity.

The Will leaves $10,000.00 in trust for the testator’s post deceased son. All the remaining real property and personalty is bequeathed to the testator’s friend, the proponent, “to start a foundation for young children and she may use my residence to accomplish this purpose.” The proponent is also nominated the trustee of the son’s trust.
