ESTATE OF ROMAN BLUM, Deceased (12/29) — In this pending proceeding, Stanislaw Chmarzynski (hereinafter the "petitioner") has moved this Court to direct the Public Administrator of Richmond County (hereinafter the "respondent") to test the DNA of the petitioner in comparison with that of Roman Blum (hereinafter the "decedent") in order to determine whether or not there is a genetic match between them. Additionally, petitioner sought the exhumation of the decedent's body in order to obtain a DNA sample to compare it with petitioner's DNA. The Public Administrator is opposed to said relief and is joined in his opposition by the Guardian Ad-Litem, representing the interests of the unknown heirs; by the Attorney's General Office, representing the State of New York; and by Teresa Musial, an interested party in this proceeding. Although petitioner withdrew his request to exhume the body during oral argument before the Surrogate, the exhumation will still be addressed below.
