MATTER OF UNIVERSAL METAL & ORE, INC., res, v. WESTCHESTER COUNTY SOLID WASTE COMMISSION ap — (INDEX NO. 1504/12)APPEAL, in a proceeding pursuant to CPLR article 78 to review a determination of the Westchester County Solid Waste Commission dated September 16, 2011, which adopted in part and rejected in part the recommendation of a hearing officer, found that the petitioner violated chapter 826-a of the Laws of Westchester County by operating a transfer station without obtaining a license from the Westchester County Solid Waste Commission, and thereupon imposed a fine in the sum of $12,500, from an order and judgment (one paper) of the Supreme Court (James W. Hubert, J.), entered September 24, 2013, in Westchester County, which denied the motion of the Westchester County Solid Waste Commission and the County of Westchester pursuant to CPLR 3211(a) to dismiss the petition, and granted the petition.
