ESTATE OF CASTELLOTTI GRANDCHILDREN’S TRUST AGREEMENT (14/26) — Peter Charles Castellotti III and Jared Christopher Castellotti, the beneficiaries of an inter vivos trust, move by omnibus motion for multiple reliefs. Upon review of all papers submitted and upon hearing oral argument the court hereby decides the matter as follows.

The application to permit the trustee to resign is denied as moot since the trustee’s own application for this relief has already been granted; the request to approve the trustee’s actions and allow her a $5,000.00 reimbursement is denied without prejudice, since those matters are to be addressed in the accounting proceeding commenced by said trustee. The request for a ruling that Peter C. Castellotti, Jr. is disqualified from serving as trustee and the request to appoint William S. Gillen as successor trustee are both denied as premature; the procedure for the appointment of a successor trustee is discussed in a prior decision and order of the court.1
