This article describes the overall status of New York no-fault cases in arbitration. It’s a story of steady, rapid growth over the past five years, with a record-setting pace of filings, year after year, and resulting challenges with us today. This article will also describe developments in other New York Insurance Programs of the American Arbitration Association (AAA), including the Storm Sandy Mediation program established on an emergency basis in early 2013, and the steady pace of SUM and UM automobile insurance arbitration.
Caseload Growth
In 2015, there were 209,900 new no-fault cases filed with the AAA, which the New York State Department of Financial Services (DFS) has designated to administer the no-fault arbitration program. The AAA has been privileged to provide those administrative services for no-fault cases to the department for over 40 years. Altogether, the value of the claims at issue in arbitration case filings in 2015 was over $500 million.
