New York improperly established regulations requiring that some young children be immunized against the flu, a state appeals court ruled Thursday.
The unanimous Appellate Division, First Department, panel said the regulations adopted by the city Board of Health in 2013 cross a “difficult-to-define” line between permissible administrative decision-making and the public policy-setting authority of the Legislature.
