A proposed rule clarifying when Commercial Division justices may have cause to seal court records is meant to “encourage” them to seal more information in high-level business disputes, according to a longtime commercial litigator who authored the rule.

Mark Zauderer, a partner at Flemming Zulack Williamson Zauderer, said the rule would bolster the attractiveness of the state’s court system to businesses and corporations that may worry their competitive secrets could be exposed in New York.
